Is there a fraud if my sister wanted her name solely on the deed without a Will?

Answered by attorney Neil J Lehto (Unclaimed Profile)
Estate Planning lawyer at Neil J. Lehto
In Michigan, if they were joint owners with survivorship, she automatically became owner upon his death. If, on the other hand, they were not joint owners with full rights of survivorship, your father's one-half interest would need to be probated. To whom did she run for what?

Is a letter of administration as personal representative of deceased owner enough to evict the tenants?

default-avatar
Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
The personal representative will be able to show Letters Testamentary, issued by the court, showing that he was appointed and has the power to administer the estate. The power of the PR includes the power to bring an eviction proceeding if that is otherwise lawful. Someone who has lived in real property for 11 years might possibly have the right to claim adverse possession, but not if they moved into the property with the permission of the owner. Letters of administration would be issued if there was no will. In that case, the decedent's natural children would inherit, not a neighbor.

If he will not write a will, is there anything I can do to protect my assets?

default-avatar
Answered by attorney Geoffrey N Germane (Unclaimed Profile)
Estate Planning lawyer at Kirton & McConkie A Professional Corporation
The answer to this question depends on how you define "my assets." If you are referring to the assets you owned before you married your current husband, and those assets have not been commingled with his assets or re-titled in your joint names, then those assets are your separate property and are not subject to his estate plan or creditors. Utah has a default plan for those who do not execute a plan of their own, and in the case of mixed families, it rarely yields a result that the family would choose on their own. I strongly suggest you consult with an attorney who focuses on estate planning (rather than one who offers it as one of many diverse areas of practice) and determine what will happen to your husband's estate in the event of his passing.
