If you refuse to sign a receipt / release or consent to probate, you will be cited to return to court on a specific date. If you refuse to appear, you will "default" which will act as a consent without having to sign anything or appear anywhere.

You can leave all of your separate property and 1/2 of any community property you have now or accumulate during the marriage to whomever you chose, including your children. Simply have a will prepared stating your wishes. It will be helpful to avoid any problems down the road if the will is drafted to include specific reference to the fact that you do not want to leave anything to your spouse and the reason why.

You can sign a Revocable Trust and put assets in the name of your trust that you want to go to your child. If you leave all to husband he can do whatever he wants if you predecease him, including give all to a new spouse. Anything joint will also pass to spouse and again he can do with as he pleases after your death.
