No, an Enhanced Life Estate Deed will not resolve this “dilemma.” An Enhanced Life Estate Deed would give your mother a life estate in the property, and you a remainder interest. Your interest in the property would vest upon the death of your mother. It may be possible for your mother to execute a Power of Attorney for the purposes of improving the home. If the home was in a living trust, then the trustee can sign the deed. If there was no living trust, then your father's estate must pass through probate. The court-appointed administrator of the estate (which could be you, if you ask for the appointment) will have the power to sign a deed in favor of whoever is to receive the property in question. I suggest you contact a probate attorney for assistance in this matter.
