It depends on what your aunt's Will states. If the Will says to the three brothers "per stirpes," this means that your father's share would go to his heirs. If the Will has language which requires the brothers to survive her, then the devise to your father would lapse. In Florida, a provision in a Will purporting to penalize any interested person for contesting a Will or instituting other proceedings relating to the estate is unenforceable.

What are the sons right on father's property if will states only one son will inherit?

Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
Mother may be entitled to continue living in the property for a period of time. If she is there, I can't imagine a justification for not allowing her children to visit her. They have the same rights as any other guest of an occupant of property.

Do I have to pay dead husbands bills in his name only?

default-avatar
Answered by attorney Don L Rosenberg (Unclaimed Profile)
Estate Planning lawyer at Barron, Rosenberg, Mayoras & Mayoras, P.C.
A spouse is not responsible for their deceased spouses individual debts. If the surviving spouse is not a joint account holder on the account such as a credit there is no liability. Also, if you used his credit that may be problematic. However, if your husband passed away and had assets in his individual name without a beneficiary, joint owner or not in a trust and the asset has to go through probate then creditors will need to be notified and they may have an opportunity to get paid. I hope this helps.
