The landlord will likely insist on probate, if he is smart. You could have an appointment by the court in less than a week, so I do not think there is an issue of waiting. A better question is whether it makes sense to go to probate, at all. If there are no other assets, then it may not. The costs of probating the estate may be more than the assets are worth. More facts are needed before anyone could advise you on that issue.
