What are the legal rights of a spouse who just discovered his/her recently deceased mate never divorced the first spouse?

You may still be the personal representative of the Estate so long as you meet the statutory requirements. However, our marriage is void and you are not considered an heir for purposes of inheritance (i.e. distribution of assets). It would also appear that the former spouse may be entitled to a portion of the decedent's Estate.

What is the average cost for Wills and Estate planning

Dear Ms. Foster, Estate planning attorneys normally charge anywhere from $1,000 to $3,500, depending on what you'd like them to do.  For instance, our office handles advance directives/living wills, guardianships, trusts, various powers of attorney, and conservatorships, just to name a few.   It sounds like your mother needs a simple estate plan, but it would be best if she reaches out to an attorney who will make sure her affairs are in order. Reach out if there is anything else I can do for you. Warm regards, Paul Cain, Esq. a.paul.cain@riseuplegal.com 904-877-1010

What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

You can contact the police, of course. However, if you bring suit against the trustees and attorney, any new attorney you hire to prosecute the casse will probably know the first attorney.
