It depends. You would need to review the adoption paperwork with an attorney to be sure. I have seen it work both ways.

Is a handshake loan from a parent to a child binding to estate if parent dies before loan is paid back?

Answered by attorney Bernard H. Greenberg
Estate Planning lawyer at Kokish & Goldmanis, P.C.
The difficulty with not documenting these types of loans is how they are proven after the death of the parent. Notwithstanding this difficulty, the loan is valid and can be enforced by the estate against the child. Due to the numerous pitfalls and problems of doing so, consult with an attorney specializing in estates.

Can an heir collect inheritance if they ran away in teenage years?

Answered by attorney Neil J Lehto (Unclaimed Profile)

Yes. His having abandoned the family is irrelevant under Michigan law. So, if there is no will, his natural heirs are his wife, if any, and his children. Otherwise, it would pass to his parents, brothers and sisters. Of course, if he made a will, his estate should pass according to what it says.
