Who is responsible for a parent's medical bills once she dies?

Answered by attorney Bernard H. Greenberg
Estate Planning lawyer at Kokish & Goldmanis, P.C.
The estate of the decedent is responsible for those bills and charges unless someone else co-signed or guaranteed the charges. One issue to watch is the emerging trend in certain states to pass the responsibility for those type of expenses to family members. You should visit with an attorney in your state who specializes in elder law matters.

Do I have to claim my father's money on my taxes?

Answered by attorney James Bloomfield Oberholtzer
Estate Planning lawyer at James Oberholtzer, Chartered
The inheritance itself is not taxable unless the estate is at least $1 million in Oregon. The income that was earned by the assets (interest, dividends, royalties) is income to you but only for the year of distribution to you. Be careful about tax liens and other claims from the past. If the inheritance did not go through probate they may attach to the assets and you will have to pay them.

It appears you don't need a small estate affidavit as the designated b beneficiaries of the 401k will receive the distribution.
