What legal document do I need to sell my deceased mothers mobile home?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
Depends if the home is considered personal property or was converted to real property. You will probably need a Florida Probate to clear title and make sure it is transferred properly. Once you do this the documents you need will depend on why type of transaction you doing (cash, owner financed, or bank loan) and what the lender's additional requirements are.

What type of Florida trust can I set up to purchase property with cash but remain anonymous from seller and protected?

You can create a Revocable Living Trust, but you will need someone, whose name will be on the documents, to serve as Trustee. There are 2 types under 689.070 and 689.071, but either will get you to the same place. What you need to know is that having a Trust like this does not protect you from your creditors. It just may make it harder to find the asset, but it is discoverable. You may want to consider some other options for protection.

I have a trust but would like to make some changes, can this be done?

Answered by attorney Carmen Beatriz Marquez (Unclaimed Profile)
Estate Planning lawyer at Carmen B. Marquez, PC
As long as it's revocable and the trust language allows you to amend it and/or restate it can easily be done. The new attorney will most likely want to restate the entire trust just keep the original name.
