Is my mom entitled to her father's retirement that just passed or can her sisters fight it?

Answered by attorney Victor L. Waid (Unclaimed Profile)
Estate Planning lawyer at Law Office of Victor Waid
The beneficiary of the retirement is your mother, since your mom's other sister is deceased who was named as a beneficiary; the remaining sisters who were not named, are not entitled to receive; the other sisters may attempt to fight but they would be liable for attorney fees and costs if they lose, which would seem to be the case here.

What kind of attorney handles this issue since I believe a request filing must be made in the county of the trust residence?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
If your friend received the required Notification of Trustee (Probate Code Section 16061.7), the document will say the principal place of administration. If not, file it in the county where the decedent died.

Would the best action be to update our wills making the two grandsons co-administrators and equal beneficiaries?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
You should meet with an attorney to update your estate plan. Any attorney here is only guessing because we are not reviewing your actual Will.
