If the wife doesn't apply for administrator after the death of her spouse, can one of their children apply?

Answered by attorney Edward L. Armstrong (Unclaimed Profile)
Estate Planning lawyer at Edward L. Armstrong, P.C.
Yes, if the surviving spouse does not apply within the period allowed after death (the time period is very short, like 20 days) then one of the children can apply to be personal representative. The child would need to retain counsel.

Is true that I don't need a power of attorney to sell mother’s house as the realtor says?

Answered by attorney Irwin G. Klein (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Hein, Waters and Klein
The person whose name is on the Deed as owner of the house must sign the Deed when the house is sold to someone else. Unless the owner gives someone else Power of Attorney to sign their name on the Deed at the sale.

Am I responsible for my dead husband's hospital and doctor bills?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
It depends on if you signed as a responsible party. Additionally to the extent your father had assets that were given to you in the past few years or upon his death, you may be responsible to the extent of the gifts or inheritance. If you received no gifts, no inheritance and did not sign as a responsible party, then you should not be responsible. If you did, you should speak with an attorney.
