She owns part of the house. She has to sign, and deliver, a deed transferring her ownership to you. Or, you can sue her for partition, in which case the probable result is the sale of the house and division of the proceeds.

I think the landlord is out of line, landlords can no longer take personal property hostage for rent. However, you may have to start a probate in order to have someone (the personal representative) with the right to bring an action to force the landlord to give this stuff up. If there's no other reason for probate other than some household personal property, it's not going to be worth it. Are there precious family heirlooms you can't live without? Send the landlord a letter saying there are things he must not dispose of that are precious to you. Do NOT do this on the phone, send a letter and keep a copy. Otherwise, decide what it's worth to you. Honestly. Offer the landlord that amount. Walk away if he doesn't take it.

You may be entitled to a portion of your father's estate under the probate laws. The statute of descent and distribution only give a portion of the estate to the surviving spouse of a decedent who died without a will. The amounts depend on the whether there were children between the two of them and whether she was the natural or adopted mother of any of these children. I would consult with a probate attorney who can evaluate the facts in your case and determine what you would be entitled to.
