When should someone file a Will after they have it changed?

Answered by attorney Richard J Kaplan (Unclaimed Profile)
Estate Planning lawyer at Richard J. Kaplan, P.A.
Wills are not filed in Florida until after they have passed away. Also, when your mother made a new Will it should have revoked her old Will so it will never be filed.

Does a will need to be witnessed and notarized to be legal in the state of Florida?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
I will must be witnessed by two people who see the person sign at the end of the documents. In addition there are other requirements for a person to sign. If you have questions about a specific will, you should have it reviewed by a Florida Estate Planning Lawyer for validity.

If the power of attorney expires when my father passed away, who is to sign the quick claim deed to transfer my father’s home ownership and title?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
His personal representative would have to sign a personal representative's deed. If there is a will, the person nominated in the will should take the will to court and start a probate case. If there is no will, then his wife, children, parents, or creditors may petition the court to start a probate case.
