What happens to the house if I die?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
If you transfer your house to your husband (which is what he's talking about don't focus on the loan, focus on the ownership; and remember, the lender will only write a loan for the person or people who own the house) nothing happens when you die, because you don't own the house any more. Your husband could write a will leaving the house to your sons; he could also change his will or sell the house after you die. I cannot imagine that there are savings so substantial from refinancing that it is worth taking this risk.

How do I get my sister to sign a quit claim on property in our mothers trust?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
You should contact a Florida Estate Planning Lawyer to review the documents to see what rights you have. If she is required to do something and refuses, you may have to remove her as trustee and replace the trustee and then have the new trustee take the actions

Can he get the house back like he is claiming and can he put me in troubles?

Answered by attorney Thomas Corcoran Phipps (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Thomas Corcoran Phipps
He voluntarily gave you the house and complied with all legal requirements. He can't take it back now, unless he goes to court and tries to set aside the transfer. If he was mentally competent at the time, I think he will have a tough time winning a case like that.
