The amount left in an account in Michigan should go a part of the residue of your mother's estate. If no estate has been opened, then please see an attorney in regard to opening up a probate estate.

Can I use the collateral on a life estate trust for a loan?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
I am unsure what a life estate trust is. You may mean life insurance trust, Regardless if the insurance policy is owned by a trust the Trust needs to be reviewed to determine the terms and conditions of the trust's operation. Also the life insurance policy may have provisions that impact your issue. You also did not advise who is appointed and is serving as the trustee and what the trustee's powers are. That being said, you should have the Trust and insurance contract reviewed by an attorney.
