If person on mortgage passes away and I am on the deed, how can I keep the property?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
The only way to keep it is to keep making the mortgage payments. Were you joint tenants or tenants in common? If the former, you own the entire house, if the latter you own half the house and his heirs own the other half and you will need to work out details with them.

Which Trust to set up?

Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
The labels you refer to are only that, labels, with no real meaning. If you set up an irrevocable trust, and it is funded by life insurance, that's an Irrevocable Trust Funded by Life Insurance. The terms of the trust matter. Please do this as part of a general estate plan, with a good lawyer. Getting something off the internet is going to cost your child more in the long run.

Can I access my father's medical records even if I do not have power of attorney?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
If you die within the first two years of purchasing a life insurance policy, the insurance company may investigate the facts to see if you misrepresented your health conditions prior to death. In order to get records, you will need to obtain letters testamentary, and go through a court procedure to order them. In the alternative, you may be able to subpoena the records by means of a 202 deposition. It's doable, but you will need counsel.
