How was my ex husband able to sell joint property after we were divorced?

default-avatar
Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
Your summary is unclear. I do not know what you mean by "I told him to take the house and sell the property." Since you got the property in the divorce, how was this done? Did you give him power of attorney? Did you sign a quit claim deed? The answer will dictate what rights and authority he had, and whether he was subject to any duties to you.

Who cashes an unclaimed funds check in a deceased family members name?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
Your grandmother will need permission from a court to cash the check. If there is no will, no debts, and the check is less than $50k, then you may qualify for a summary proceeding.

If a will was left to 3 brothers to equally share property and a home and 2 have deceased, does the remaining brother get all shares?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
Maybe. Probate of the Will should have resulted in a personal representative's deed to the three brothers, if it was done with survivorship, then survivor owns all. If as tenants in common, then the estates of the deceased brothers own their parts.
