What are we entitled for if dad didn't have a will?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Based upon the long term of the marriage, you are not likely entitled to anything. If you father had property that he had before the marriage and kept it separate, you might be entitled to something, but that is rare.

Can I be sued for using the estate meant for my child?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
Yes. Anyone can sue anyone. The question is whether she has a good case. How did you get custody? If custody was through the court you may be able to have that court approve how you spent the money. You need to speak to an attorney. This response is not intended to create an attorney client relationship and is solely based upon the information set forth in the the inquiry.

My child wants to ask her dads gf to move out of her dads house to secure the property while her dad is in icu on deaths door. How can she do this

Robert W. Hughes
Answered by attorney Robert W. Hughes (Unclaimed Profile)
Estate Planning lawyer at Robert W. Hughes & Associates, P.C.
The child needs to obtain guardianship and conservatorship over her father if she wants to control his property.  I assume only the father's name is on the property? The girlfriend is at least a tenant and must be given 30 days notice to vacate.
