When a decedent has left no will and his or her estate includes real estate or is over $150,000; the estate must be submitted to the Probate Court through a petition. The court will then appoint an "Administrator" to govern the estate administration. The Administrator is often a family member who makes that petition in the initial filing with the court; if no family member steps up to be the Administrator; then the court will turn the matter over to the County Public Administrator.

You can bypass probate if the estate is too small and title to real property does not need to be changed to give you clear title. If a clear property title cannot be transferred in a sale, then the title issue will have to be addressed in a probate court, before you can transfer a clear title to a buyer. Suggest you consult with a probate lawyer.
