Would the best action be to update our wills making the two grandsons co-administrators and equal beneficiaries?

Answered by attorney Norman Harry Green (Unclaimed Profile)
Estate Planning lawyer at Irsfeld, Irsfeld & Younger LLP
I don't know your grandsons or daughter-in-law. Only you can decide who should be executor. Only you can decide who should be the beneficiaries. Even if you leave everything to your grandsons, you may prefer to name only one as executor, or possibly to name somebody else.

My mother passed away, she didn't leave a will and we are 10 siblings who is entitled to her home?

Answered by attorney Jeffrey R. Gottlieb (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Robert H. Glorch
If the home is in your mother's name alone, then it is an asset of her estate. Her estate would pass equally among her children so you would all have an equal interest. Probably the course of action would be to sell it and split the proceeds. Talk to a probate attorney.

How can I make sure my son receives the inheritance he is due?

Answered by attorney Robert James Slotkin (Unclaimed Profile)
Estate Planning lawyer at Robert J. Slotkin
That's outrageous! Does she have a lawyer? If she does, you need to call and tell him what is going on. If she is acting without a lawyer, you need to get a lawyer and file a petition to have her removed as p.r. ASAP and force her to file an accounting. Life Insurance companies will not deal with a p.r. unless the estate is the beneficiary of the policy. They must give the funds to the beneficiary. How did she manage to get at the funds? Something isn't adding up. I will be happy to talk to you.
