Hire a probate lawyer who practices in the county in which your daughter lived and died.  Depending on the size of the estate, you may be able to file a Small Estate Affidavit.  This costs less than a determination of heirship and does not require a court appearance.

Would a Statutory Durable POA override a spouse?

I think the POA overrides the prior spouse, even if the prior marriage is ruled valid. I do believe, at least in my state, PA, a married person can designate whoever he or she wants as agent in a POA notwithstanding blood or marriage. WHere blood or marriage come in is with the will, for inheritance. Make sure he has a will, so in the event the last wife would contest the estate and the prior marriage be ruled in her favor she wont get the bulk of the estate. See a local TX lawyer for more specific details regarding TX law.

Talk to your attorney. This should be an ongoing conversation. If you are not clear on your responsibilities, which can vary from case to case, then you should ask your attorney for more information. The Judge will not send you anything about your duties. Discuss with your attorney how your compensation should be computed. Generally speaking, I advise my administrator clients to keep a log of their time and what they did for the estate.
