I received a refund check in my partner’s name yesterday for the old policy, do I have the ability to cash this check?

The correct thing to do is to either pay it into the estate, and take it out, or to ask the insurance company to reissue it to your name as the sole heir.

What do I need to do to close this estate and get our distributions?

Sounds like you are a bit impatient re the closing of the California estate. The estate in New York needs to be closed first, including the collection of the New York judgment, i.e. foreclosing on the New York property and selling the same. The attorney in California is right to not front the money for the New York matter; that is the job of the executor, and in this case the beneficiaries of the California estate should sign their consent to the expenditure for New York estate foreclosure, or the attorney in California can and should pursue California court authority as to how to proceed before spending any California funds on the New York matter. Of course you could advance the necessary funds out of your own pocket to speed the process.

What am I entitled to if my mom died while sharing apartment with my aunt?

default-avatar
Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
It depends. If all of the belongings were your mother's, then you would at least be entitled to a share of them. If they belonged to your aunt, then you are not entitled to anything, at least not yet. If you cannot tell what belonged to whom, then I think you are probably out of luck. It is often VERY difficult to determine who owned what personal items, because none of these assets have title. So proving it in court is always tough. It is even tougher to need to take your aunt to court over personal property.
