What type of tenancy should we choose?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
It depends upon what you are trying to accomplish You both need to sit with an estate planning attorney to discuss your goals Do not try to cut corners and save a few pennies trying to do this yourself as the tax consequences and potential litigation consequences will be much, much more expensive.

What steps can we take in order protect Mom's assets or prevent over taxing upon her death?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
Depending on circumstances, there may not be much. Your mother may not be able to do anything and the daughter, who could potentially act, is governed by fiduciary standards. Your best bet is to sit down with an estate planning attorney and review all of your facts and objectives. The attorney can recommend the best option.

I have inherited 1/2 of the home and am living in it, can I be evicted by my brother who owns the other half?

Estate Planning lawyer at The Law Office of Nathan Wagner
He can't evict you, but he can make you pay rent for living in the home. If you don't pay the rent, then he can have you evicted. However, you should be able to count what you have paid for taxes and upkeep toward the rent, so be sure to keep careful records.
