If the debt was in his name alone and was not secured by collateral, the debt becomes a debt of his estate, and not of his heirs. Any property owned by his estate would be potentially subject to satisfying the debt.

Of there is no will, and no debt (aside from debt secured by real estate) then you can clear title by using an affidavit. A probate lawyer or title company can do this for a few hundred dollars.

If all you have is non-probate property, all you have is property which does not pass under a Will.  In that circumstance, you do not need a Will.
