The car was sitting on the side of the road? Whose car? Your car. YOUR CAR. Who did you tell police was driving your vehicle? You did not. Therefore, it was you, because it is your car and there is no one else around. You have a hopeful attorney, I don't know about good. Good luck to you.

Will I go to jail for my first DWI offense?

Answered by attorney Richard Wagner
DUI/DWI lawyer at The Law Office of Richard Wagner, A Professional Corporation
It's possible but not likely. The high BAC could cause the judge to enhance your sentence to include doing some jail time. You're probably looking at a stiff fine, a long alcohol education program and some community labor while being on court probation.
