What can I do so I don't go to jail?

If you fully comply with the conditions of your probation then you won't be refered back to court and so there would be no chance of you going to jail.  I am a little unclear on why you had that questions since you did not imply that anyone was threatening you with jail, but hopefully that answers the question.

A "personal" rule of thumb is that the police and/or D.A. can charge someone with anything. Whether or not they can prove the charges beyond a reasonable doubt is to be seen.

Why does it take up to 2 years to file a misdemeanor DUI case?

The DA has plenty of cases. They will get to you when they get to you. Why are you complaining when there are no vodka bottles complaining that you have not gotten an opportunity to drink them? You will get to them in due time, just like the prosecutor will get to you.
