Your attorney is correct. Unless there are circumstances which support both convictions, the prosecution will accept one conviction. We use a 'mitigation' package to explain your position and insure that you get one conviction. Please call if you need help. I would explain our approach. Ed Dimon 732-797-1600

In MI, probably no jail time if the breathalyzer was .16 or less. If more, than up to one year in jail.

Is it still possible to get my Driving Under the Influence expunged if my fine went to collections?

Answered by attorney Joshua James Price
DUI/DWI lawyer at Defending Rights Law Center
You need to take care of all terms and conditions of probation before a Judge will consider expunging your record. The fine is a part of terms and conditions of probation, thus you must pay the fine before you can have your record expunged.
