Yes, you can be charged with DUI, further when you failed to provide a sample of your blood or breath you are likely to be prosecuted for "refusal." You must be lawfully arrested in order to trigger the "implied consent" law which would require you to submit to chemical testing. You may have defenses to the DUI including the fact that you weren't driving, the prosecution has to demonstrate driving, frequently they proceed with circumstantial evidence which may, or may not, be persuasive to a jury.

It is legal. He is in custody at the hospital. You have no more rights to visit him in the hospital, than you have to visit him at the jail.

You have raised a lot of issues.  The stop may be bad, the search may be bad, the arrest after passing exercises should be looked at closely.   You should contact an experienced criiminal and DUI attorney.  It sounds like your were arrested for either DUI, possession, or reckless driving or all 3.   You should not try to do this alone.  My advice would be to get an attorney in or near the county where this occurred or get an attorney where you live to coordinate this.
