If you are relating that you had a blood alcohol level of .21 you may have had a few beers earlier in the week but apparently you continued drinking. That level is significantly higher than any tolerated blood alcohol level allowed and therefore I believe you will be prosecuted. Engage an attorney.

While DWI cases often seem skewed in favor of the prosecution, there is some chance that an assertive defense showing that too few Field Sobriety tests were completed, and that for physical reasons you could not perform one of them, might be helpful in challenge the grounds for the arrest. Some counties are tougher, some easier, on dropping DWI down to Reckless Driving, but it can be accomplished at least some of the time. Please keep in mind that if the cop has grounds to believe you were driving while impaired by alcohol, you can still be charged, even if the chemical tests are suppressed.

No Miranda: The remedy for not being read your rights ("Mirandized") is that any admissions found to be involuntary that you may have made to the police cannot be used against you. It does not mean an automatic dismissal of the charges against you. The police know this so they don't bother Mirandizing you if they don't need your statements or a confession to prove your guilt. No expungement: I am sorry to be the one to tell you that there is no expungement in the State of New York.
