When did they conviction occur, there is a very short time period during which you may have a right to appeal. From what you are stating conviction seems like it might be successfully appealed.

Unfortunately DUI convictions cannot be sealed or expunged. That is becasue the person convicted receives an Adjudication of guilt. Unlike many other charges where a person can receive a withhold of Adjudication, the statute in Florida does not allow it. Also, anytime you have been Adjudicated on any offense, you are ineligible to expunge anything else, so the other charges cannot be sealed either.
Unfortunately DUI convictions cannot be sealed or expunged. That is becasue the person convicted receives an Adjudication of guilt. If you blow a 1.0, didn't completely fail the sobriety test, but when blood was taken it was lower then 0.08, can or should it be thrown out?

You cannot blow a 1.0, because that would mean that your blood was totally alcohol. IF you blew a .10, then you have a problem.
