Short answer: Yes, they can use anything against you. Not all prior offenses MUST be used against you, but all of the can. Whether it is the policy to use such old events is largely dependent on the poicy of the particular county's State Attorney's Office. You should hire a lawyer who is familiar with your particular county.

Your 0.7% doesn't help very much. First a minor is not allowed to have any detectable alcohol in his or her blood. Secondly, you could be charged with driving while intoxicated, even if your blood alcohol content is less than 0.8%. You could help yourself by retaining a skilled lawyer.

This all depends on his availability to testify as a witness and the contents of incident report with regards not only to the content but to the judge's determination of its admissibility. It is also possible that law enforcement may still try and get the video tapes of the breath test and field sobriety tests admitted as evidence. You should not take any action and/or inaction based on this information. You should consult with a local attorney in person as soon as possible regarding these matters.
