Will having to put an ignition immobilizer stop me from early probation termination?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
You should discuss this with your attorney. If the ignition interlock is a term and condition of your sentence, likely you will not be able to get your probation terminated early. An attorney in your area may be able to help answer your question.

In Colorado to be guilty of DUI a person must be "driving" a motor vehicle, which has been interpreted to mean that they were in "actual physical control" of the vehicle. Seems to me you need to analyze whether a drunk person in a car with a 10 year old is in actual physical control of the vehicle, despite not being behind the wheel - was he directing the driving behavior of the 10 year old, helping in some way - and if so does that put him in "actual physical control". One could also ask whether the drunk person was committing child abuse by having the 10 year old drive?  Good luck.

Edward D Flint
Answered by attorney Edward D Flint (Unclaimed Profile)
DUI/DWI lawyer at Edward D. Flint Attorney at Law
How do you afford to not have a lawyer? You are looking at license suspension, thousands of dollars in fines, probation and treatment costs, and a criminal record among many other penalties.
