Do I have to mention a pending paraphernalia charge at my preliminary hearing for a DUI?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
It seems like two questions, if you have an attorney you should rely on the advice of counsel, if not, you should consider hiring an attorney. At your preliminary hearing you should not be asked about any pending charges unless you are actually sworn and testifying, and then, hopefully your attorney can keep that question from getting an answer. A skilled criminal defense attorney can help you.

What will happen if I have violations on my interlock?

Answered by attorney Mark R. Thiessen
DUI/DWI lawyer at Thiessen Law Firm
No warrant. The court will just call your attorney or maybe the court will just arrest you the next time in court. You should tell your attorney immediately. And if no attorney, then you really are at that point where you need one.

If I am on probation for DUI, can I still carry around my legally owned firearm?

Answered by attorney Mark R. Thiessen
DUI/DWI lawyer at Thiessen Law Firm
Depends on the terms of your probation. You have to read those carefully. Usually they do not allow you to.
