What can happen in court for a DUI charge?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Your court outcome will depend upon what county you are in, the policy of the Prosecuting agency, the evidence against you and the skill of your attorney. You should contact a DUI attorney to discuss the facts of your case, the possible defenses and likely outcomes. A refusal is a serious allegation, by statute it carries an extra 48 hours of custody and a one year (or more) license suspension without any provision for a restricted license.

If I transfer the title of my car to someone else, can I get out of putting an IID on it?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
Yes, if you don't own a car and aren't driving a car, you won't have to put on the interlock device. Be warned that if the court finds out that you actually driving, additional punishments are likely.

How long do I have to wait to be able to start sealing my record if I had a OWI 5 years ago?

Answered by attorney Patrick S. Fragel (Unclaimed Profile)
DUI/DWI lawyer at Patrick S. Fragel, Attorney at Law, P.C.
The Michigan Expungement statute does not allow you to "seal the record" for violations involving OWI. The OWI conviction will remain on your driving record and criminal record permanently. If you get convicyed of OWI again, the first offense will be used to enhance the sentence.
