Based on the numbers off test can I beat my DUI?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
I suspect that you cannot beat the DUI on your own. The alcosensor is not calibrated like the breathalyzer. You cannot assert your 5th amendment privileges when you are asked to perform tests, because 5th amendment involves words, not behavior. You are clueless.

What happens if I do not show up to complete a 45-day jail sentence after having probation revoked?

Maximum penalty for a OWI is 1 year in jail. Since you were ordered to do 45 and you didn't , I would suspect that you could look at double that amount of time.

Don't know enough facts. Assault of a police officer may be either a gross misdemeanor or felony. 2nd DUI: mandatory minimum of 30 days in jail, 2 year license revocation, followed by one yer interlock on vehicle, fines and assessments of approximately 1200.00; drug and alcohol treatment per the court.
