You must filed a lawsuit to expunge it to get it off your record. It cannot be used to enhance punishment in the future but it can be "considered" in the sense that the State does not look at you the same way.

Not sure I know what you are referring to. The prosecutor decides whether to bring a charge, not the judge. If you were charged with a felony, a preliminary examination (aka probable cause hearing) must be held. If the judge determines there is not probable cause, s/he will dismiss the charge.

I dont know TX law, but your suspension period has probably expired. You need to speak with a local lawyer that handles driver license restoration issues. The lawyer can get your record from the TX Department of Motor Vehicles and see what is needed to restore.
