You were the victim of a battery. When the police were called, did the police call you the victim? Were you consuming alcohol? If you were the legitimate victim of a battery, then your being a victim cannot violate your probation.

What do we do if they said they had no record of a DUI for him and of course he has no case number to go by but has court hearing scheduled?

He should really be asking his own attorney this information or hire one that actually has a brain. The DMV doesn't file on cases that are a 0.07 they just stay the suspension pending the court hearing. So the DMV hearing will likley be a win. The courts in a lot of counties for example San Diego will file on a 0.07/0.08 and go for the jugular. They have 1 year to file from the date of incident. If his lawyer can't answer these questions than he should fire him and hire someone else.

He may be in big trouble. In most states (every state) there is what is called the implied consent law. These means that when you get your license and you drive on the roads of the state, you give implied consent that you will submit to a breath test if requested by an officer. If you refuse, then Department of Licensing WILL revoke his license for one year (minimum). This is the case, even if he were found not guilty of the DUI. My advice: HIRE AN ATTORNEY.
