Are DUI field sobriety tests pass or fail?

Answered by attorney Patrick Owen Earl
DUI/DWI lawyer at Patrick O. Earl
These tests are just balancing test that law enforcement and the law use to determine if the officer thinks the person has had too much to drink. The Pass/Fail idea is probably correct but it is more than that. The count up clues that the person does or doesn't do and then with the observations and smell and attitude of the person determine if they believe he/she has had to much to drink.

My 21 year old was charged with a DUI but passed the breathalizer. will he loose his license

DUI/DWI is a serious charge. the nj supreme court said no 'plea bargains' on DWI. your attorney must attack the basis for the 'stop' of the validity of the 'field test'. what was the basis for your son being stopped ? what were the 'field tests' ? what was the breathalyzer reading ? these are crucial facts i need to know.
