Are DUI field sobriety tests pass or fail?

Answered by attorney Patrick Owen Earl
DUI/DWI lawyer at Patrick O. Earl
These tests are just balancing test that law enforcement and the law use to determine if the officer thinks the person has had too much to drink. The Pass/Fail idea is probably correct but it is more than that. The count up clues that the person does or doesn't do and then with the observations and smell and attitude of the person determine if they believe he/she has had to much to drink.

Is it still possible to get my Driving Under the Influence expunged if my fine went to collections?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
DUI/DWI lawyer at Nelson & Lawless
Some CA convictions can be 'expunged' from criminal records by proper application and Petition to the court, but only IF there was no felony prison time sentenced whether served or not, and if it was not for certain listed sexual crimes, and if all terms of sentencing and at least one year of probation are completed, and if there are no new charges pending.

Is it normal to be fired for a DUI?

Answered by attorney Craig W Elhart (Unclaimed Profile)
DUI/DWI lawyer at Craig W. Elhart, PC
It depends on the type of job and company policy. Many insurance companies will not insure a driver who has a OWI on his/her record for a period of time leaving an employer no choice but to terminate the employee in order to maintain insurance coverage. Since Michigan is an at will employment state, an employer can terminate someone who is not under an employment contract for any reason or no reason just not an illegal reason. Without more details, I cannot provide a more precise answer.
