Short answer, "no." If you have not attended and completed the DUI program required by the DMV you will be unable to get a license until you do, regardless of the extra steps you took to get and maintain your sobriety or the fact you served your country, I wish it was different.

If you blow more than a 0.08, the DA will file a criminal charge against you. Because you haven't been convicted of a DUI before, you will not have mandatory increased penalties. However, if you are convicted of this DUI, the judge has discretion to increase your punishment past the minimum mandatory punishment based on your past PI conviction.
