How long should my license be suspended for a refusal to blow (breathalyzer)?

Answered by attorney Larry K. Dunn (Unclaimed Profile)
DUI/DWI lawyer at Weo Office Suites, LLC
In Nevada, the law does not allow someone to refuse to submit to an evidentiary breath or blood test. If a person refuses to submit to a breath test, the police are authorized to force a blood test. Therefore there is no driver's license revocation for refusing an evidentiary test.

Is a trainee police officer has the right to operate a breathalyzer machine?

You need an experienced DUI attorney in your area to thoroughly early review your case. I'm not sure what you mean by trainee, but the person administering the breath test must be trained and certified.

Answered by attorney Steven Jed Alpers (Unclaimed Profile)

You will not have a dui conviction on your record if the charges were dismissed. You may still have a license suspension on your record for 10 years.
