If the officer no longer employed how will this effect my case?

Answered by attorney Eric J Trabin (Unclaimed Profile)
DUI/DWI lawyer at The Trabin Law Firm, P.L.
Possibly. The officer could theoretically still show up to court, however, it is a lot less likely whether the officer will show. If the officer does not show up for your trial then the case will likely be dismissed.

When did they conviction occur, there is a very short time period during which you may have a right to appeal. From what you are stating conviction seems like it might be successfully appealed.

Can I be charged with a DUI if the keys were outside of the car and the arresting officer smelled?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Under these facts you have a defensible case, an experienced DUI defense attorney, with a forensic toxicologist should be able to demonstrate that you were not under the influence of drugs when you were driving. Depending on the grounds for the contact, your friend may also have grounds to challenge the search and any charges that arise from the paraphernalia seized.
