The element of Operation, as well as Public Way and .08% or Impaired Ability must be met to convict you of OUI. If the government cannot prove that you were the operator of the vehicle then you should be found not guilty. Your lawyer should be able to address this with you. If you do not have a lawyer, get one. You may have a winnable case, but without a lawyer, you will not likely prevail.

If they filed within 1 year it's not a statute problem. If there's a warrant, it doesn't go away. You'll have to go to court to handle it. Hire a lawyer first.

You are looking at a first if this is a California DUI. The case in 2002 is eleven years before the new arrest and is therefore outside the 10 year "look back period" for prior convictions and the mandatory sentencing that a prior engenders.
