He has a brain injury but yet you say he's fine? I doubt he would agree with your assessment on that. No one is saying you did it on purpose, nevertheless, that doesn't change the fact it happened. I can understand you being scared but I found your attitude offensive. DUIs involving injury are serious crimes and prosecutors rarely give deals. You need to invest in an experienced DUI attorney to thoroughly review your case to see if any motions can be filed and what your best options are.

It probably can't be done because each DUI conviction carries with it increasingly severe penalties. If you were to expunge your record and then get a subsequent DUI, would it be your first or would it be your second?

Depending on the facts, it could be anything from a simple misdemeanor DUI (assuming the driver wasn't the cause of the death) up to Gross vehicular manslaughter while intoxicated or all the way up to second degree murder. It all depends on the facts and the person's history (if any).
