What can I do if I was falsely accused of tampering with ignition interlock?

This is a horrible problem that many have with interlocks. You have to request a hearing with the DAAD and prove to them that you did not tamper, by your testimony, car repair receipts, etc. You will probably get reinstated if it shows that you blew immediately afterwards and had a .00 reading for your bac. I have done many of these and the biggest problem is waiting the 6 to 8 weeks to get a hearing, which nothing can be done to speed up the process. It is also wise to have an attorney familiar with the DAAD in which you have to report to.

Will I be charged a DUI if I refuse a breathalizer test?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Yes, you can (and likely will) be charged with a DUI. The case against you will depend, to a large degree, on your driving and field test performance. A refusal also Carries ash extra 48 hours and a 9 month DUI program as additional consequences if you are convicted as a first offense.

Should I go for sobriety court if the judge suggested it and my lawyer said I should?

Your lawyer, if familiar with area and practices there often would probably know what is best for you. I only practice in Lansing and surrounding areas, and I know if someone should go to sobriety court. You can get a restricted license if you are in Sobriety Court, which is great and only started recently. Sobriety Court is expensive.
