Yes you can be charged ONLY if there is evidence that you were in the drivers seat at one point (WA State law). Before the accident, as the driver, can someone put or testify that you were there? Or after the accident were you seen in the drivers seat, like trying to move the car?

You were informed when you were read your rights in regards to blowing in the breathalyzer. You were informed by dozens of people when you get arrested you need to retain an attorney. You bonded out of jail, and failed to consult an attorney. Now you are out of luck.

In Utah, the minimum jail sentence is 2 days in jail. If you have a clean record, you would likely be given the minimum unless there is something about your DUI that makes qualifies it for a penalty enhancement. Although if you hire a talented lawyer, you may avoid a DUI altogether.
