How long after the DUI charge can be expunged in New York and should Miranda rights be read on a DUI arrest?

No Miranda: The remedy for not being read your rights ("Mirandized") is that any admissions found to be involuntary that you may have made to the police cannot be used against you. It does not mean an automatic dismissal of the charges against you. The police know this so they don't bother Mirandizing you if they don't need your statements or a confession to prove your guilt. No expungement: I am sorry to be the one to tell you that there is no expungement in the State of New York.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.

Can I still get a DUI after getting my license back?

The nurse gave you your physical license. That does not mean your driving privileges were not suspended. Your blood will be tested. If the blood reveals more than .08 BAC, then you will be charged for DUI.
