If I'm going to plead guilty to a DUI, do I need an attorney?

Cynthia Russell Henley

Most courts will not allow you to proceed without a lawyer unless you are able to demonstrate the ability to represent yourself properly. Moreover, if you plead guilty without having a lawyer review the case, you will never know if it is defensible.

Is there a statue of limitation on dui cases?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
First, the statute of limitations is a non issue in your case because you were charged within two months. So, you had a chance to get all your ducks in a row, and file a speedy trial demand. SO, five years later a trial is into a surprise to you. Second, they don't know that you were not driving, otherwise they would have not charged you. I love when people that know what is in someone else's head cannot even afford the attorney that will represent them, or the doctor that will operate on them, but they consider themselves smart. Smart means you pay for what you get. In five years, you have into earned $ 3500 for an attorney.

What happens if my attorney withdraws from my case because I missed a court date?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
DUI/DWI lawyer at The David F. Stoddard Law Firm
There are several possible options. One would be to hire another attorney. Another would be to check into whether your attorney sent in a representation letter to the court or Solicitor's Office. If so, the attorney may have to file a Motion with the Court to be relieved as counsel on your case. In other words, he may still be your attorney whether he likes it or not. If you paid the entire fee, you could file for a refund with the fee dispute resolution committee (call the SC Bar for this).
