The answer to that question depends on a number of variables. There is no mandatory minimum jail sentence for a first time offense assuming no one was hurt and there were no kids in the car. In cases where an individual's BAC is over .20%, it is not uncommon for the state to be seeking 10-15 days in jail. Either way you should seek the advice of an attorney.

Blood tests for marijuana will either show active THC or Carboxy THC. Carboxy THC is the metabolized by-product of active THC that stays in your system for days or weeks. Just having Carboxy THC in your system will not support a DUI prosecution.

If this is your first DUI (or 'OWI' as we say in the trade in Wisconin), and there are no aggravating factors, there is no jail time associated with it. If it is a second or subsequent offence, or if you were driving with a child under 16 in the car, it would be a different story. But an uncomplicated first-offence OWI usually results in an unpleasant forfeiture (size of which depends on the amount of alcohol measured), and a number of other requirements, but no jail.
