This is a very jurisdiction-specific and fact-specific question. Why was he on pretrial release at the time of his DUI? Where did this happen? Each county has its own procedures and criteria for pretrial release. If the original charge was alcohol-related (like another DUI), then it is not unlikely that they will hold him in jail until both charges are disposeed. Judges are just lawyers who didn't like practicing law. They do not want to be forced out of office by releasing some alleged drunk driver who can't stay sober and off the roads. On the other hand, if your bf was on pretrial release (ROR) for some relatively innocuous charge (say, shoplifting) there is a better chance that the court will grant him a bond. Especially since he has served a month already. Good luck.

It sounds like this matter is in Eaton County since they are known for their Fast Track Programs for DUIs . I would strongly suggest retaining counsel and then taking steps as soon as possible to get this matter taken care of which will include turning yourself in. It only gets worse the longer you wait. Be prepared for some jail time as that is probably a likelihood at this point, but at least you will have the relief of knowing the matter is resolved and you can move on with your life without constant fear of running into the police. Good luck.

Can I be charged with a DUI if the keys were outside of the car and the arresting officer smelled?

Florida law doesn't care about the keys. Our statute says if a person is in "actual physical control" of the vehicle they can be arrested for DUI. Sleeping in the back seat of a car, keys with someone else a person can be arrested and found guilty. Unfair? Yes, talk to the democrats in the legislature they passed the law and block any changes.
